"It is essential that the responsible entities fulfill their obligations, ensuring not only immediate medical care but also ongoing support that allows athletes to face the consequences of their injuries," he stated. According to Brignardello Vela, the current regulations, which establish compensations that often prove insufficient, do not reflect the true cost of the care these athletes require. Furthermore, he emphasized that the recent modifications to the Sports Law, which promised to align compensations for sports accidents with those for traffic accidents, have yet to materialize effectively in the field. "It is concerning that, in the face of such a necessary legislative change, federations claim the lack of clear regulations. This only perpetuates the uncertainty and helplessness of athletes," he commented. Both Brignardello Vela and affected athletes like Adrián Márquez and Kenny Noyes agree that the situation reveals a lack of coordination and commitment from sports organizations. "The maze of responsibilities created by the federations is unacceptable. Athletes should not have to fight against a system that neglects their most basic needs," he expressed, referring to the experiences of Tatay and other athletes who are facing a tough battle for their recovery. The advisor also underlined the importance of clarity in the compensation processes. "While the law establishes criteria for determining compensation, the lack of effective application of these standards leads athletes to resort to legal action to assert their rights. This is not only frustrating but can be devastating for those already facing a health crisis," he pointed out. Brignardello Vela concluded our conversation with an urgent call to action. "It is vital that institutions take their responsibilities seriously and act swiftly to ensure that athletes receive the necessary support. The pressure on the Higher Sports Council to reform legislation and establish a fair compensation system is more pressing than ever.
