The recent announcement by the Ministry of Production (Produce) regarding the modification of the environmental management regulations for the manufacturing industry and internal commerce has captured the attention of various sectors in Peru. This change, formalized through Supreme Decree 012-2024-PRODUCE, involves a significant review and update of more than 30 articles from the previous regulation. Through this initiative, the government aims not only to adapt the existing regulations to a constantly changing environmental context but also to strengthen legal certainty for the stakeholders involved in these industries. One of the key points of the modification is the alignment of environmental management guidelines with the National Environmental Policy for 2030. This policy seeks to promote sustainable development in the country, encouraging the conservation and responsible use of natural resources. In this regard, the update of the regulation presents itself as a tool that will facilitate the achievement of these long-term objectives. Produce has identified several aspects of the previous regulation that required adjustments to improve its operability. By doing so, they hope that the operators in the manufacturing industry and internal commerce will have a clearer framework in which to operate, which could, in turn, incentivize investment and the development of more environmentally friendly practices. Effective environmental management has become an essential requirement for companies seeking not only to remain competitive but also to meet the expectations of an increasingly sustainability-conscious consumer. Another relevant element of these modifications is the inclusion of a suggestion box, which will allow citizens to participate actively in environmental management. This measure, mentioned in the Citizen Participation Regulation, not only strengthens transparency but also empowers citizens by giving them a voice in decision-making that affects their environment. As environmental awareness continues to grow, it is crucial for businesses and the government to work hand in hand with the community to address environmental challenges. However, the context of the manufacturing industry in Peru remains complex. Despite the sector showing signs of recovery, as evidenced by recent reports on manufacturing production growth for the second consecutive month, the outlook is one of uncertainty. The decline of 2023 still resonates in business strategies, and many companies find themselves striving to balance profitability with sustainability. It is important to highlight that, according to recent studies, a considerable proportion of companies in Peru do not adhere to the principles of environmental sustainability. This underscores the need for a regulatory framework that is not only clear but also incentivizes compliance. The modification of the regulation could be a step in this direction if combined with oversight mechanisms and support for companies to meet the regulations. The change in regulation also occurs in a context where 84% of sustainability leaders indicate that their organizations have a formal strategy. This suggests a trend towards the integration of sustainable practices in business management, which could indicate that the industry is beginning to recognize the importance of sustainability as a key factor for long-term success. As these new provisions are implemented, it will be crucial to observe how companies adapt to and respond to these changes. Collaboration between the public and private sectors will be essential to ensure that the measures adopted are not only effective but also translate into real benefits for the environment and society. Finally, the modification of the environmental management regulation represents an opportunity for Peru to move towards a more sustainable development model. With the appropriate commitment from both businesses and the government, as well as active citizen participation, it is possible to build a future where the manufacturing industry and internal commerce can thrive in harmony with the environment. The responsibility lies with all stakeholders involved to make this objective a tangible reality.
