After the enactment of Law No. 31988 which restores bicameralism in Peru, the National Jury of Elections (JNE) has presented to the Congress of the Republic a bill that seeks to adjust the electoral regulations for the election of senators and deputies. This proposal aims to adapt the legislation to the new composition of the Parliament, which will now have 190 members, divided into 60 senators and 130 deputies. One key point of the JNE's proposal is the modification of Article 20 of the Organic Law of Elections (LOE), which establishes the threshold that a political organization must reach to access the distribution of seats in Congress. Given the increase in the number of congressmen, it is necessary to reconsider this threshold, which currently requires obtaining 6 congressmen in more than one constituency. In this regard, the JNE proposes that the threshold be percentage-based (not less than 5%), both for senators and deputies, which would allow for a more equitable distribution of seats in Parliament. Likewise, it is suggested that the election of senators be mixed, combining multiple and single electoral districts, which would provide greater representativeness at the national level. Regarding the Chamber of Deputies, the JNE's proposal suggests that the election be carried out through multiple electoral districts, considering the population increase. Additionally, it is proposed to modify Article 84 of the LOE to establish that the President of the Republic may dissolve the Chamber of Deputies in case of censure or lack of confidence in two Councils of Ministers. Additionally, the bill contemplates the extraordinary convocation of elections for the new Chamber of Deputies, which would complete the constitutional term of the previous one. It also proposes modifications related to the apportionment figure, double preferential vote, the order of the vote results, and the situation in which the elected president has also been elected as a senator or deputy, among other aspects. In summary, the JNE's proposal aims to adapt the electoral regulations to the new parliamentary reality of the country, guaranteeing a more equitable representation and strengthening the democratic system. If approved by Congress, this initiative would lay the groundwork for a more efficient and transparent operation of the Senate and House of Deputies within the framework of bicameralism restored in Peru.
