Former president Martín Vizcarra continues to fight to annul the disqualification to hold public office imposed against him by the Congress of the Republic in 2022. Through a writ of amparo filed before the Constitutional Court (TC), Vizcarra seeks to declare null the parliamentary decisions that disqualified him for 5 years, alleging violation of due process and his constitutional rights, especially the right to vote and be elected, as well as to participate in political life. The case has generated great expectation and controversy in the public opinion, as Vizcarra also faces other judicial proceedings, such as the trial for alleged corruption in the "Lomas de Ilo and Hospital de Moquegua" case, where the prosecution has requested 15 years in prison against him. Additionally, he is being investigated for alleged acts of corruption in the Ministry of Transport and Communications-Provías Nacional, as well as for the "Vacunagate" case. The former president's lawsuit has been referred to the TC Plenary, where a prompt resolution is expected. However, the complexity of the case and the various arguments presented by both parties suggest that the process could be extended for several months. In this sense, experts in constitutional law have pointed out that the TC cannot summarily reject the lawsuit, but must hold a public hearing to analyze it in detail. On the other hand, critics have questioned Vizcarra's actions, stating that he seeks to use legal maneuvers to evade investigations against him and regain his participation in political life. They have also emphasized that the Attorney General's Office has shelved an investigation against him, which has been interpreted as an attempt to protect him from possible criminal consequences. Amidst this scenario, the TC faces the challenge of pronouncing itself objectively and transparently, guaranteeing respect for due process and the constitutional rights of all parties involved. The final decision made by the Court will have repercussions not only for the case of Martín Vizcarra, but also for the judicial and political system of the country as a whole. In this context, it is essential for the TC to issue a resolution based on the current legal framework, avoiding any kind of political or media influence. Only in this way can impartiality and justice be ensured in this emblematic case that has captured the attention of the Peruvian citizenry. The TC's resolution will set an important precedent regarding the separation of powers and respect for the Rule of Law in the country. As events unfold and the date of the Constitutional Court's resolution approaches, Peruvian society will be attentive to every step and decision made in this case. Transparency, objectivity, and respect for the law must prevail at all times, ensuring that justice is administered equitably and in the public interest.
