The full session of the National Jury of Elections (JNE) has made a decisive decision regarding the political party National Alliance of Workers, Farmers, University Students, Reservists, and Workers (A.N.T.A.U.R.O.), led by Antauro Humala, stating that they do not have the authority to declare a party illegal for anti-democratic behavior. This determination has arisen in the midst of a process being carried out by the Public Ministry regarding this particular political group. Based on Article 14 of the Political Organizations Law (LOP), the possibility of legalizing parties for anti-democratic behavior is established; however, the JNE has clarified that this authority belongs to certain public bodies and not to them. According to the statement issued, the power to declare a party illegal for undemocratic behavior lies with the Supreme Court of Justice of the Republic, at the request of the Attorney General or the Ombudsman. For a party to be declared illegal, its activities must systematically violate fundamental freedoms and rights, promote violent acts, support terrorism, or contribute to spreading fear and intimidation. These criteria are essential to determine if a political organization should be considered illegal for undermining democratic principles. It is important to note that once a political organization is registered, the JNE only has the authority to oversee the operation of its premises and committees, through the National Directorate of Supervision and Electoral Processes. In case of non-compliance with requirements, a sanctioning process is initiated, which, if the non-compliance persists, can lead to the suspension of the party's registration. In this context, the JNE has made it clear that they do not have the authority to verify the democratic behavior of registered political parties, leaving the decision on illegality in cases like that of the A.N.T.A.U.R.O. party led by Antauro Humala in the hands of the Supreme Court. The request by Congressman Alejandro Muñante of Renovación Popular to annul the registration of the party linked to Antauro Humala has sparked a debate on the democratic conduct of political organizations in the country, emphasizing the need to ensure respect for fundamental principles of democracy in the political sphere.
