The National Jury of Elections (JNE) has issued a statement clarifying that it does not have the authority to illegalize the political party National Alliance of Workers, Farmers, University Students, Reservists, and Workers (A.N.T.A.U.R.O.), led by Antauro Humala, for antidemocratic behavior. This statement comes amid a process being carried out by the Public Ministry regarding said political group. According to the Political Organizations Law (LOP), the declaration of illegality of a party for antidemocratic behavior falls under the jurisdiction of the Supreme Court of Justice, at the request of the Attorney General or the Ombudsman. This measure would be applied in cases where fundamental freedoms and rights are systematically violated, violence is promoted as a political method, support for terrorist organizations is endorsed, among other antidemocratic aspects. The JNE specified that once a political organization is registered, its competence is limited to monitoring the operation of party premises and committees, without the authority to verify the democratic behavior of such organizations. This statement from the JNE comes in the midst of a request from Congressman Alejandro Muñante to annul the registration of Antauro Humala's party for alleged antidemocratic behavior. However, the institution has made it clear that it is not within their scope to carry out this type of verifications. On another note, in a parallel context, it is noteworthy that the reform of impediments for candidacy has been in legislative limbo for almost a year, with no priority in Congress. This reform is of utmost importance to ensure the suitability of candidates seeking public office, and its stagnation reflects a lack of attention from lawmakers on a crucial issue to strengthen democracy and transparency in the electoral process. In summary, the position of the JNE regarding the illegalization of parties for antidemocratic behavior, coupled with the stagnation of the reform of candidacy impediments, highlights the need for reflection and action by authorities and society in general in defense and strengthening of democratic principles in the country's political system.
